Curima — Terms of Service

1) Who we are

Curima, LLC ("Curima," "we," "us," "our") provides the Services described in these Terms. Contact details are in Section 13.

2) Eligibility

Children & COPPA. Curima can be used by learners under 13 only with verifiable parental consent (or, in a school setting, with authorization from the school acting as the parent's agent for educational use). Parents/guardians may review, delete, or revoke consent as described in our Privacy Policy.

Account responsibility. You are responsible for all activity on your account. Keep your password secure and do not share it.

Compliance. You must comply with all applicable laws, including export controls and local rules about online content.

3) Your account & content

Ownership. You retain ownership of any content you create or upload to Curima ("User Content")—including your memory webs/knowledge graphs, attachments, and annotations.

License to Curima. You grant Curima a worldwide, non-exclusive, royalty-free license to host, store, process, display, and share your User Content as needed to operate and improve the Services (e.g., syncing across devices, rendering graphs, enabling sharing you initiate, and creating backups). This license ends when your content is deleted from our systems, subject to reasonable backup/archival cycles.

Responsibility. You are responsible for your User Content and must ensure it complies with these Terms.

Prohibited content. Do not post or share: (i) anything unlawful, harassing, abusive, hateful, or otherwise objectionable; (ii) spam, scams, or misleading information; (iii) content that infringes intellectual-property, privacy, or publicity rights; (iv) content that includes minors' personal data without required consent.

Pseudonyms. You may use a pseudonym, but you remain responsible for your conduct.

4) Acceptable use

You agree not to:

• Use the Services for any unlawful purpose or to violate others' rights.
• Harass, threaten, or abuse others; attempt to circumvent safety or consent mechanisms.
• Interfere with or disrupt the Services, including by introducing malware or excessive automated traffic.
• Use bots/scrapers or reverse engineer the Services without our prior written permission.
• Access or use another user's account without permission.

5) Sharing, collaboration, and safety

Private by default. Your memory webs are private unless you choose to share them. When you share, viewers can see the items and metadata you've permitted.

Moderation. We may review and remove content, or restrict accounts, if it's reported, flagged by automated systems, or required by law/contract (e.g., a school agreement).

Blocking/reporting. You can report suspected violations to support@curima.com.

6) Our rights

We may (with or without prior notice):

• Suspend or terminate accounts that violate these Terms or our Privacy Policy.
• Modify, suspend, or discontinue the Services (or any part) at any time.
• Remove or restrict access to User Content that violates these Terms or applicable law.

7) Intellectual property

The Services (including design, software, text, graphics, and trademarks) are owned by Curima or our licensors and are protected by intellectual-property laws. Except as expressly allowed, you may not copy, modify, distribute, sell, lease, or reverse-engineer any part of the Services.

Feedback. If you send ideas or feedback, you grant Curima a free, worldwide, perpetual license to use them without restrictions or compensation.

8) Privacy

Our Privacy Policy explains how we collect, use, and protect information (including parental rights under COPPA). By using the Services, you agree to our Privacy Policy.

9) Subscriptions & payments

Free access. Some features are free.

Paid features. If you subscribe, you agree to the pricing and billing terms presented at purchase, including taxes where applicable and auto-renewal unless you cancel. Trials convert to paid unless canceled before the trial ends.

Cancellation. You can cancel at any time in account settings; cancellation stops future renewals but does not retroactively refund past charges.

Refunds. Unless required by law, payments are non-refundable.

10) Educational & AI features; disclaimers

Educational use only. Curima provides learning tools and content for educational purposes. Curima does not guarantee learning outcomes or academic performance.

AI features. Curima may use automation and machine learning to suggest content and practice. AI outputs can be imperfect; you should review them critically.

Third-party services. The Services may link to or rely on third-party services (e.g., login, payments). We are not responsible for those services.

No warranties. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT). We do not warrant that the Services will be uninterrupted, secure, or error-free.

11) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) CURIMA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; AND (B) OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID TO CURIMA FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM AROSE (OR $50 IF YOU PAID NOTHING).

12) Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you (e.g., by email or in-app message). Your continued use of the Services after the effective date of the new Terms constitutes your acceptance.
